Does your agency have playgrounds? Does your agency use engineered wood fiber for playgrounds? If you answered yes to those questions, you’ll want to know what the US Department of Justice (DOJ) said in a June, 2020 settlement agreement with an agency when DOJ found that every single playground inspected, including new playgrounds, failed the playground access requirements. The Park Maintenance Institute has organized an opportunity to connect and learn from experts about future implications for playground owners.
Our speakers will review the federal regulatory playground requirements in the Americans with Disabilities Act (ADA), and discuss how these elements interface with the American Society for Testing and Materials (ASTM) voluntary playground safety standard. The speakers will review ADA enforcement and the critical role played by families of children with disabilities in this and other disputes. Finally, the speakers will spend time describing maintenance smart practices that can keep your agency off of the news feed and the front page.
Our experts for this session are John McGovern and Tony Malkusak. McGovern leads the Accessibility Practice at The WT Group, LLC and helps parks and recreation agencies address ADA compliance. His firm has served more than 450 cities and counties across the country, and he is a regular contributor to NRPA. He’ll address the ADA issues in this dispute. Malkusak is a landscape architect and owns Abundant Playscapes. He is a long-time member of ASTM, and a popular instructor in the Certified Playground Safety Inspector program. He’ll address the playground safety issues in the dispute. Both speakers enjoyed careers in public parks and recreation.
