The salary level for an employee to be classified as exempt under the Fair Labor Standards Act (“FLSA”) will be raised to $47,476 annually, effective December 1, 2016. Now is the time to review your municipality’s exempt and non-exempt classifications and make any necessary corrections to those designations. Review the different categories and criteria for exempt status under the FLSA, such as administrative, executive and learned professionals, and discuss the “salary basis” test and revised salary threshold.
